President Jair Bolsonaro (PL) sanctioned on Wednesday (21) a law approved by the Congress that orders health insurance plans to cover services not included in the National Supplementary Health Agency (ANS) list. In practice, plans are obliged to cover treatments that are not listed by the agency, but have been prescribed by doctors, provided that there are scientific grounds for the request. The discussion around the case began after the Superior Court of Justice (STJ) ruled out that private health plans are not obliged to provide consultations, exams, and other procedures that are not included in the ANS’ list. The National Federation of Supplementary Health (FenaSaúde) regretted Bolsonaro’s sanction. The entity alleges that the change undermines the capacity of health insurers to forecast their cost. According to them, it hinders the proper pricing of plans and compromises the predictability of welfare expenses, which may lead to higher monthly prices and mass expulsion of beneficiaries from supplementary health. FenaSaúde said that it will appeal to the Judiciary to try to prevent the law from being maintained.
